Gore Began To Actively Campaign For More Pollution Regulation. “In the past, the company avoided talking in public about its position on proposed environmental regulations because it didn’t want the companies that buy its air-cleaning filters to think Gore was trying to tighten standards just so it could sell more pollution control equipment, Coons said. Instead the company would go directly to its industrial clients with details about how Gore’s products could help them comply with current rules, or new rules being developed by federal regulators. ‘What we haven’t done in the past is said it in front of Congress,’ Coons said. When I bought my Sunday paper in the WAWA last night, it was the last one on the shelf. I have a feeling that there are a lot of New Castle Countians with questions for Chris Coons, Paul Clark, Bob Weiner, Jack Markell and Carolann Wicks concerning traffic congestion and our ever-threatened quality of life. The reactions have been pouring in. Here’s one:

….Under the provisions of Ordinance 03-069, sites identified by DNREC (Department of Natural Resources and Environmental Control) as brownfields would be exempted from conducting a site resource capacity analysis and from paying impact fees. An operational analysis may be required for major plans and a Traffic Impact Study (TIS) will be required only if requested by the Department of Transportation (DelDOT). On a recommendation by DelDOT, the County may restrict gross floor area (GFA) and DelDOT may require transportation improvements as a condition of its letter of no objection.
The ordinance also makes two other important changes to the UDC. First, it removes the requirement for a Planning Board public hearing for minor redevelopment plans (it retains the requirement for major redevelopment plans) and, second, it expands uses allowed in Industrial (I) zoning districts to include general office, without limitation, and mixed-use development, subject to the same standards for mixed use in the OR (Office, Regional) zoning district.
…..With the passage of the Redevelopment Ordinance (Ord 01-098) in April 2002, New Castle County took the most important step in addressing some of the most serious problems in the Unified Development Code since the UDC was approved by Council on December 31, 1997. County Executive Chris Coons has made redevelopment, especially of brownfields, part of his vision for New Castle County. To advance that part of his agenda, he hired Karl Kalbacher as Director of the Office of Economic Redevelopment. Karl has been participating in the Comprehensive Development Plan Update Process and has provided important comments regarding the impact of various Comp Plan goals on economic development.
Karl used his brownfields background to strengthen Ordinance 06-007, the latest ordinance to modify the redevelopment process, introduced January 24, 2006. The third to tweak the redevelopment process, this ordinance modifies the UDC to apply “substantially the same standards and conditions to both Brownfields and other redevelopment sites.”
Ord 06-007 removes multiple impediments to redevelopment: just as with brownfields, redevelopment plans need not provide a site resource capacity analysis on any site containing no natural resources; redevelopment plans can be qualified beyond S, ST, or TN zones; rezonings on brownfields or redevelopment sites are not subject to the triannual rezoning dates; major land development plans that are not subject to a rezoning may proceed directly to record plan submission following exploratory sketch plan approval; reconstruction of nonconforming buildings destroyed by more than 50% must begin within 10, rather than 5 years; there is a redevelopment density bonus in any zoning district up to 25% of the maximum nonresidential GFA or multifamily dwelling density allowed in Table 40.04.110A or 25% of the legally established nonresidential GFA or multifamily dwelling density on the site, whichever is greater.
Most significantly, “in any OR, BP, I or HI zoning district on lots containing at least fifty-thousand (50,000) square feet GFA of existing development, any size expansion of an existing industrial or manufacturing use provided no TIS is required by DelDOT” will be a minor land development plan.

New Castle County Executive Chris Coons says county workers from three unions face layoffs as he presented his budget for the 2010-2011 fiscal year Tuesday evening.
“I do not see how it is fair for one half of our workforce to continue giving back, while the other half does not,” New Castle County Executive Chris Coons said.
Last year the police and paramedics unions negotiated 5% pay cuts and other concessions in a three year deal. Locals 459, 1607 and 3109 agreed to the cutback for one year in exchange for job security.
Coons says he’s gone back to negotiate with those three AFSCME unions that represent 725 employees to ask them to continue the 5% pay cut for this budget year, without success.
So now many of the county’s park, sewer and maintenance workers, along with clerical and technical employees and managers and supervisors face losing their jobs.
“Workers in those three unions will be facing layoffs. It is their choice,” Coons said.
“While I respect the collective bargaining process and have been open to negotiating a fair resolution to this, the three unions I mentioned have so far made a choice that will require hard consequences. So I will be working with our management team over the coming months to reduce the workforce and further align this government.”

Increase property & sewer taxes; layoff 75 county employees
Coons Seeks 25% Property Tax Hike: If approved by County Council, the tax hike would be the 2nd biggest in county history and would raise an extra $21 million.
The average annual property tax bill would rise by about $100 to $501. Coons’ spending plan also calls for a 10% increase in sewer fees.
The overall budget reflects the impact of the recession, particularly in housing. Revenues from the statewide real estate transfer tax have plummeted as home sales swooned.
Coons’ spending plan would trim personnel costs by $4.8 million, an amount he said could be achieved by laying off 75 to 100 employees. If layoffs are needed, they would occur across the board and include public safety services such as police & paramedics.
Coons said he is continuing to negotiate with the county’s six unions to see whether they would accept furloughs or some other form of payroll reductions. So far, the unions have balked at Coons’ proposed furloughs, suggesting that taxes instead be raised to save county jobs.

“First, the much ballyhooed position of public safety director, which Coons re-invented after it was off the books for eight years, has been vacant now for 14 months, just a couple months short of how long the last public safety director, Ron Frazier, held the job. … Since Frazier left, Coons has had a change of mind about the need for the public safety position, which has a $140,000 salary level. In 1984, Freebery began working for defendant New Castle County as its Superintendent of Parks. This position was a classified position within the New Castle County merit system. n1 In 1996, Thomas Gordon was elected County Executive of New Castle County. He appointed Freebery’s sister, Sherry Freebery, to serve as New Castle County’s Chief Administrative Officer. At that time, county departments were managed by Directors who were appointed by the County Executive. Pursuant to state law, Directors served at the pleasure of the County Executive and, thus, those positions were unclassified and unprotected by the New Castle County merit system.
In 2003, Christopher Coons — who was at that time President of the New Castle [*4] County Council — lobbied the Delaware legislature for a bill that would allow the County Executive to appoint General Managers that served at his pleasure, and, thereby change the General Manager to a position that was not protected by the merit system. Appellant Freebery opposed the bill and lobbied against it. The bill passed the Delaware House of Representatives but was not voted on in the Senate and, thus, was not enacted.
After the bill failed in 2003, Gordon wrote a memorandum to each General Manager. The memorandum explained that the General Manager positions were protected by the merit-system, and, therefore, the General Managers could not be terminated except for “just cause or non-performance.” [A 467-68] The memorandum, however, acknowledged that “someone could change state law” and thereby remove the protections. [A 467]
In 2004, Coons and Sherry Freebery opposed each other in the Democratic primary for the County Executive. Appellant Freebery supported his sister in the election. Coons defeated Sherry Freebery in the primary and won the general election. Shortly after taking office, County Executive Coons again lobbied the Delaware legislature to remove the General Manager [*5] position from merit system classification. This time, the bill passed both houses and became effective in February of 2005.
Coons and his staff then conducted a review of the county government. On April 6, 2005, Freebery was offered the choice of whether to retire, resign, or be terminated and chose termination. Freebery subsequently filed this civil action.
II.
The District Court granted summary judgment on Freebery’s Fourteenth Amendment due process claim, finding that Freebery had no protected interest in his job when he was terminated. In evaluating Freebery’s due process claim, we first determine “whether the asserted individual interests are encompassed within the fourteenth amendment’s protection of ‘life, liberty, and property.’” Dee v. Borough of Dunmore, 549 F.3d 225, 229 (3d Cir. 2008) (quoting Robb v. City of Phila., 733 F.2d 286, 292 (3d Cir. 1984)). If we conclude that such an interest is at stake, we then “decide what procedures constitute ‘due process of law.’” Id. (quoting Robb, 733 F.2d at 292).
